- Introduction
MassVR LLC, a Delaware limited liability company (“MassVR”, “we”, “us” and other similar terms) provides games, including any playtest programs, alpha/beta testing, user experience research, and Early Access programs (collectively, “Games”), websites including www.massvr.com and their subdomains (collectively, “Websites”) and other online services including any social media or communication channels we host (with the Game and Websites collectively, “Services”).
MassVR respects your privacy and is committed to protecting the data we collect. This Privacy Policy (“Policy”) outlines what Personal Information we collect, for what purposes this data is used, and how we protect this data. We would like to be transparent in explaining our processes in regards to your Personal Information and recommend you read this Policy in its entirety. Accessing and/or using our Services constitutes your acceptance of this Policy. If you do not agree with this Privacy Policy, please do not access and/or use our Services.
We will not collect, use, store, or otherwise process your Personal Information beyond what is outlined in this Policy. This Policy does not apply to any data collected by or provided to any third-party except as otherwise detailed in this Policy.

2. Updates to this Policy
We may update this Policy at any time by publishing the new Policy on this page. We will notify you of any updates to this Policy via email and/or prominent notice on our Website when changes become effective. We will update the “Last updated” date at the top of this Policy as changes to this Policy are published and become effective.
We advise you to review this Policy periodically for any changes. Changes to this Policy are effective the moment they are published on this page.
3. Who does this Policy apply to?
This Policy applies to every user of the Services provided by MassVR (“User”, “you” and other similar terms).
4. How do we handle Children’s Personal Information?
Our Services are not intended for persons under the age of consent required to process their Personal Information according to the country in which the person resides (“Child”, “Children”). As such, we do not intentionally or knowingly collect, use, store, or otherwise process any Personal Information of Children.
If you are aware that a Child has provided us Personal Information, please submit a support ticket at https://massvr.com/contact/ or email us at info@massvr.com so that we may remove this data. User age is collected by third-party gaming platforms in accordance with their policies; we do not collect any data regarding User age.
5. What Personal Information do we collect?
We may collect different types of information depending on how you use our Services. “Personal Information” or “Personal Data” is considered to be any information that relates to an identified or identifiable individual. We do not intentionally or knowingly collect, use, store, or otherwise process any sensitive Personal Information. We may also collect information that does not generally identify you but may be associated with your account. We may use data that does not identify you for permissible use under applicable law.
5.1 When you use our Games, we may process the following information:
- Identification and account information such as third-party User profiles and usernames (such as your Meta username or Steam username), in-game username, unique or online ID (such as third-party IDs), profile photos and/or avatars, friends list;
- Commercial information such as your purchase history of in-app purchases and downloadable content (DLC);
- Information about physical characteristics such as height, head and hand-tracking and other physical movement, and biometric data including voice and audio recordings;
- Information about how you interact with our Games such as length and frequency of use, crash reports, User preferences and settings, items and features you use, and your achievements;
- Information associated with the device you use when accessing our Games and Services such as IP address, brand of the device, operating system, browser type, hardware information, and screen resolution; and
- Other information such as your name and email address that you provide us directly when submitting support tickets.
5.2 When you use our Websites and Services, we may process the following information:
- Identification and account information such as your name, email address, username or unique online ID (such as your Discord or Steam username);
- Internet and network activity such as information relating to how you use our Websites and Services;
- Information associated with the device you use when accessing our Websites such as IP address, brand of the device, operating system, browser type, hardware information, and screen resolution; and
- Other information and content you may provide us directly when contacting us, submitting support tickets, submitting applications for employment, or interacting with our public social media and communication channels (such as messages sent in our public Discord servers or comments left on public social media posts).
6. How do we collect Personal Information?
When you use services provided by MassVR, we may collect information in the following ways:
6.1 We may collect Personal Information when you provide it to us directly. Examples include, but are not limited to:
- When you submit a contact or support ticket, we may collect your name, email address, and any other information provided that is deemed relevant to your inquiry;
- When you respond to a survey or questionnaire, whether distributed through email or any other channel of communication, we may collect your responses; and
- When you elect to receive any newsletters or promotional materials from us, we may collect your email address, name, and topics of interest. When we send you emails, we may also collect data on when you open them and how you interact with them so that we can better understand and improve our User experience.
6.2 We may collect Personal Information automatically when using our Services. Examples include, but are not limited to:
- When you play our Games, we may collect movement and height data, voice data, information on length and frequency of use, crash reports, and information relating to items, features, and your achievements; and
- When you use our Websites, we may use Cookies to track how you interact with and use our Websites.
6.3 We may collect Personal Information from third-party sources as it relates to your use of our Services. Examples include, but are not limited to:
- When you purchase in-app items or DLCs, we may receive information regarding your purchase history from platforms such as Meta or Steam;
- When you submit a support ticket through third-party systems, such as when you submit an in-game abuse or support ticket, we may receive information from the relevant third-party platform such as your Oculus ID;
- When you join, follow, or interact with our social media and communications platforms, we may receive information such as your name, username, and/or information you share publicly on those channels; and
- We may receive information that has been made public on third-party social media platforms, such as likes and follows, to the extent that your personal User preferences and settings allow for on those platforms. If you do not want to share this information, we advise you to update your settings on the relevant social media platform.
We do not track users of our Services over time and across third-party websites or online services and therefore do not respond to Do Not Track signals. We are not aware of any third-party that tracks users of our Services over time and across third-party websites or online services.
7. How do we use the Personal Information we collect?
We collect Personal Information for the following purposes:
7.1 To provide our Services to you. For example, we use your username and friends list to provide you with multiplayer and matchmaking Services in our Games. We also use physical and movement data such as height and head and hand tracking so that we can immerse you in our virtual reality Games.
7.2 To recognize you as a User. For example, we use your username to keep your score and experience/achievements earned in our Games.
7.3 To improve our Services. For example, we use your crash logs and hardware/device information to diagnose issues with our Services across different platforms. We may also use information you provide us in surveys and questionnaires to develop new features and improve our Services. We use information collected automatically in our Games, such as how you use and engage with features, items, and achievements, so that we can balance the User experience.
7.4 To administer our Services. For example, when you provide us with Personal Information through contact or support tickets, we use this information to respond to and address your inquiry.
7.5 To market our Services to you. For example, when explicitly provided to us, we may send you email communications and newsletters with information regarding our Services.
7.6 To prevent and detect abuse or fraud. For example, we may use information provided to us in support tickets or abuse reports to moderate our Services and prevent, detect, and investigate illegal or suspected illegal activity.
8. What is our legal basis for collecting your information?
We only collect, use, store, or otherwise process your Personal Information when we have a valid legal basis in accordance with relevant governing laws. Examples of valid legal bases include:
- When you consent to our use of your Personal Information. This includes when you consent to receive electronic marketing communications from us and when your consent to the use of Cookies. When the processing of your Personal Information is base on your consent, you may opt out at any time by submitting a support ticket at https://massvr.com/contact/, by emailing us at info@massvr.com, or by unsubscribing from electronic marketing communications using the link at the bottom of such communication;
- When it is necessary to perform and conclude and contract with you and to provide you with our Services. This includes using Personal Information such as platform usernames and unique identifiers to make our Services available to you when requested;
- When we or a third-party have a legitimate business interest that does not outweigh your privacy rights. This includes using information to ensure the functionality and security of our Services, for internal analytic purposes, and for development of our Service; and
- When we have a legal obligation. This includes our use of data to prevent and detect fraud and illegal activity.
9. Who do we disclose your Personal Information to?
We may disclose your Personal Information to a third-party, such as a service provider or contractor for a business or operational purpose. We will never sell your Personal Information. When we disclose Personal Information to a third-party for a business or operational purpose, we enter into a contract with the party that describes the purpose and requires the service provider or contractor to both keep that Personal Information confidential and to not use it for any purpose except to perform the contract. These third-parties may include:
- Backend platform service providers for purposes such as error and crash reporting;
- Website and email service providers;
- Other users for purposes such as using multiplayer or networked Services where your Personal Information is publicly available. We will never share private or personally identifiable information with other users outside of normal function of our Services;
- Our lawyers, consultants, accountants, business advisors, and similar third-parties who owe us duties of confidentiality; and
- Authorities when we are legally obligated to do so in order to satisfy the law or a court order, to detect and address fraud, or to protect our rights and Services;
We do not rent, sell, or share Personal Information with third-parties for their direct marketing uses as contemplated by California’s “Shine the Light ” law (Civil Code § 1798.83), unless we have your explicit permission.
10. How do we retain your Personal Information?
We only retain your Personal Information for as long as necessary for the purposes in which that information was provided to us and to fulfill our obligations to you as a User, as set forth in this Policy and to the extent necessary to comply with our legal obligations, such as when we are required to retain your data to comply with applicable law, to resolve disputes, and to enforce our legal agreements and policies. When determining how long we retain Personal Information, we evaluate the nature and sensitivity of your protected information, the risk of harm from unauthorized use or disclosure of your information, the purposes for which we process your Personal Information and whether those purposes have been achieved or can be achieved through other means, and the applicable legal requirements. It is our policy to delete Personal Information collected through specific features or Services if we stop operating those features or Services.
11. What limitations do we place on the collection and use of your Personal Information?
We limit the purposes for which we collect, use, store, or otherwise process your Personal Information. We will only use your Personal Information for the Services you choose to access and for the purposes notified to you unless we otherwise obtain your consent. We limit the Personal Information we collect, use, store, or otherwise process to what is adequate, relevant, and reasonably necessary for those purposes.
12. How do we secure your Personal Information?
We take appropriate measures to ensure your Personal Information is secure as is appropriate to the volume and nature of information processes and the risk involved with consideration to the size, scope, and type of our business and have implemented contractual, technical, administrative, and physical security measures designed to protect your Personal Information from unauthorized access, use, loss, publication, disclosure, and modification. We review these security measures on an ongoing basis as new technologies and methods become available. Please note that our security measures as detailed in this Policy do not guarantee the security of your Personal Information, as is the nature of information exchanged over the internet. In the event of a security breach, we will notify the appropriate regulatory authorities and any Users affected by the breach within 72 hours after we become aware of the breach.
We encourage you to take personal steps to ensure the security of your Personal Information when publicly sharing information while using our Services.
13. How do we handle the transfer of your Personal Information?
We may collect, use, store, or otherwise process your Personal Information outside of the country in which you reside. Our primary place of business is in the United States. We may transfer your Personal Information to the United States to carry out certain operational needs as described in this Policy.
We will comply with applicable data protection laws of the country or region in which you reside when transferring your Personal Information outside of that country or region. When transferring your Personal Information out of other countries or regions, we implement the appropriate safeguards to ensure your Personal Information is adequately protected. 14. How do we monitor your Personal Information?
We are committed to fostering a positive and respectful community for all of our Users. As part of our efforts to ensure the safety and well-being of our Users, we may monitor chats, audio recordings, and other data when you make use of our Services to prevent abusive, offensive, or otherwise inappropriate behavior within our community.
Recordings may be collected during in-game communication, such as multiplayer or networked interactions, voice chats, or other features where Users may communicate. For this purpose, we may collect your language preference, location, chats, audio logs, and the context in which such interactions have taken place. We manage this moderation internally and do not share this information with third-parties unless otherwise required to by law or court order. If it is determined there have been any offenses to our Code of Conduct as detailed in our Terms of Use, then a community manager will decide whether to take action and what that appropriate action may be. Recordings will only be stored for as long as is necessary to detect offenses, report them to the community manager and/or the authorities, make a decision and maintain the evidence as may be required or needed to support such decision.
15. What rights do you have to your Personal Information?
You have certain rights in regards to your Personal Information.
You have the right to request that we disclose to you certain information about how we collect, use, store, and otherwise process your Personal Information. This includes the right to requesting information regarding what categories of Personal Information we collect, the sources from which we collect your Personal Information, our purpose for collecting your Personal Information, what third-parties we disclose your Personal Information to, if and to whom we sold your Personal Information to in the event of a sale, and the specific pieces of information we collect about you (also known as a data portability request).
You have the right to review the data that MassVR collects about you at any time, and make corrections to any incorrect or incomplete information.
You have the right to request the deletion of your Personal Information and we will carry out your request for deletion and will only maintain minimal Personal Information to document your request and the steps we took to execute your request.
You have the right to restrict and object to certain types of processing of your Personal Information. You have the right to revoke consent you have provided us at any time.
You have the right to file complaint with the relevant data protection supervisory authorities in the country in which you reside regarding the way we collect, use, store, or otherwise process your Personal Information.
We will honor your requests regarding your Personal Information to the fullest extent of our ability with respect to and subject to applicable law. We are legally prohibited from deleting your Personal Information in situations where there is an overriding legitimate ground for retaining that information, such as to prevent fraud or when your request adversely affects the freedoms and rights of other individuals. We are legally obligated to request you verify your identity for you to exercise these rights so as to protect against fraud and prevent someone else from accessing, modifying, or requesting the deletion of your Personal Information.
We will not discriminate against you for exercising your privacy rights under applicable law. We will not deny you access to our Services for exercising your privacy rights except when permitted under applicable law. We will not charge you different prices or rates for our Services, either directly or through discounts or other benefits or penalties, for exercising your privacy rights. We will not provide you a different quality of our Services as a result of you exercising your privacy rights.

We cannot respond to requests or provide Personal Information as it relates to you without verifying your identity or authority to make such requests.
We endeavor to respond to verifiable consumer requests within 30 days of its receipt. If we require more time, we will inform you of the reason for extension and the length of extension in writing by mail or electronically based on your communication preferences.
Disclosures of Personal Information will cover the 12-month period preceding the receipt of a verifiable consumer request unless otherwise explicitly requested. We will provide an explanation for the reasons we cannot comply with a request, if applicable.
For data portability requests, we will provide to you your Personal Information in a format that is readily usable, easy-to-understand, and should reasonably allow you to transmit the information from one entity to another entity without hindrance.
You may appeal a decision regarding your verifiable consumer request by submitting a support ticket at https://massvr.com/contact/ or emailing us at info@massvr.com. In your appeal, please include an explanation of the reason you disagree with our decision regarding your request. We will inform you in writing of any action taken or not taken in response to your appeal within 60 days of the receipt of an appeal.
We will never charge you a fee, penalty, or otherwise demand any compensation to process and respond to your verifiable consumer request unless it is excessive, repetitive, or unreasonable. If we decide your request warrants a fee, we will provide to you in writing the reason for that decision and a cost estimate before we complete your request.
